B. das Hochschulwesen in Deutschland kennt. Das Werk untersucht, ob dieser gesetzesfreie Zustand im Bereich der außeruniversitären Forschungsorganisation und Forschungsförderung verfassungsgemäß ist. Neben einer Analyse des status quo wird der Frage nachgegangen, welche verfassungsrechtlichen Anforderungen sich aus der Wissenschaftsfreiheit ergeben, und ob der Gesetzgeber gesetzliche Regelungen erlassen muss. Dies geschieht teilweise unter Einbeziehung der Rechtslage in Frankreich und Österreich. Die Untersuchung kommt zu dem Ergebnis, dass es für den Bereich der Organisation der außeruniversitären Forschung einer gesetzlichen Regelung bedarf, die die wissenschaftsadäquate Organisation der außeruniversitären Forschungseinrichtungen sichert. Ebenso wird eine gesetzliche Regelung für den Bereich der indirekten Projektförderung durch eine Forschungsförderungseinrichtung als verfassungsrechtlich erforderlich angesehen.
